I certify that I am at least 18 years old and that I possess full legal capacity to exercise this authorization and hereby release Promax from any liability or claims whatsoever in connection with this Release by myself, my successors, and/or my assigns.

If I am under 18 years of age, my guardian, by entering his/her name below and clicking on the “Guardian Authorization” icon below, authorizes and approves this Release.

I hereby grant permission to Promax Nutrition Inc. (”Promax”), its successors, assigns, and those acting on its authority to publish and to use any material submitted by me hereunder, including, without limitation, my name, quote, caption, text, picture, photograph, video and/or sound byte (”Submission”) on its website and may be displayed with my name at Promax events or used in promotional and advertising materials used to support Promax and its products in print publications, television, internet, and other multimedia presentations and I hereby assign the copyright and all other rights in and to the Submission to Promax. I understand that whether or not the Submission is used by Promax, it will become and remain the property of Promax and will not be returned. I understand that, if selected for use, currently or at any time in the future, in Promax’s sole discretion, the Submission may be copyedited or cropped as deemed appropriate by Promax.

I further warrant that the Submission was prepared by myself and does not and will not infringe or violate the rights of any other party, including copyright interests and I shall indemnify, defend and hold Promax harmless from and against any losses, claims, damages, awards, penalties or injuries incurred, including reasonable attorneys fees, which arise from any claim by any third party that the Submission infringes a copyright or any other property right arising out of Promax’s use of the Submission. I further acknowledge that once the Submission appears on Promax’s website, the Submission can be downloaded by any computer user and I agree to indemnify and hold Promax harmless from and against any claims related to such use and any claims concerning unauthorized publication of name and image by third-parties must be pursued by me against the unauthorized user.

I acknowledge and agree that Promax does not pay any expenses incurred by me in developing the Submission, nor does Promax pay for any Submissions published.

I understand that I have the right to request, in writing, removal of any photo contained in the Submission from the website within a reasonable amount of time, but there is no obligation by Promax to do so.

I have had sufficient time to review and seek explanation of the provisions contained above, have carefully read and understand them, and agree to be bound by them. I voluntarily and irrevocably give my consent and agree to this Release and Waiver.

For submitters under 18 years of age:
Dear Parent or Guardian:

Your child is submitting the above described materials (”Submission”) for the use by Promax in its advertising and promotional media. If selected, the Submission may be displayed with the name of the child in publications, television, Web sites, and other multimedia presentations as described above. By clicking on the “Guardian Authorization” icon below, you are certifying and agreeing that you have read the terms of this Release and agree to be bound by the terms hereof on behalf of your child and for yourself.
